Welcome to Body Proof (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of all services, websites, applications, features, content, and technologies provided by Body Proof (the “Platform”), including our background reporting tools and dating features.

By accessing or using the Platform in any manner, including visiting our website, creating an account, accessing reports, or using dating features, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines (to be published). If you do not agree to these Terms, do not use the Platform.

1. Eligibility

To use Body Proof, you must:

• You must be at least 18 years old
• Legally capable of entering into a binding agreement
• Not prohibited by law from using our services

We may suspend or terminate your account if you fail to meet eligibility requirements or violate these Terms.

2. Acceptance of Terms

These Terms apply to all users of the Platform. Your use of any aspect of the Platform constitutes your acceptance of these Terms. Continued use after any update or modification constitutes your acceptance of the revised Terms.

3. Services Overview

• Background reporting tools (user-submitted and public info)
• Dating platform with verified profiles
• Profile verification (e.g., STD badges, ID check)

4. Description of Services

Body Proof provides a hybrid platform with two main functionalities:

• Background Report Services: Users may view reports derived from publicly available data, user submissions, and verification processes.
• Dating Features: Users can create profiles, connect with others, and optionally display verified health or identity statuses.

Body Proof is not a consumer reporting agency as defined under the Fair Credit Reporting Act (FCRA) and the reports provided are for informational purposes only. They may not be used for employment, credit, housing, insurance, or any purpose covered by the FCRA.

5. User Verification

We offer optional identity and STD test verifications. These are for informational use only and not guarantees of identity, health, or conduct. Users are responsible for their own interactions and decisions.

6. Account Responsibilities

To access most features, you must create an account and provide accurate and complete information. You agree to:

• You must provide truthful information
• Promptly update your information if it changes
• Are responsible for all activity under your account
• Maintain the confidentiality of your login credentials

We reserve the right to reject or revoke any username or account that impersonates someone else, infringes on intellectual property, or otherwise violates these Terms.

7. User Content, License, and Conduct

You are responsible for all content you submit, upload, or display on the Platform, including profile information, photos, verification documents, and comments.

By submitting content, you retain rights to content you post but you grant Body Proof a non-exclusive, worldwide, royalty-free license to use, host, reproduce, distribute, and display such content for purposes related to operating and improving the Platform.

You agree not to:

• Submit false, misleading, or defamatory content
• Violate the rights of others (privacy, intellectual property, etc.)
• Engage in harassment, threats, or abusive behavior
• Post or distribute harmful or illegal material

8. Prohibited Uses

• Harassment, stalking, or threats
• Uploading false or defamatory content
• Reverse-engineering or tampering with the service
• Using Body Proof for credit, employment, or tenant screening

9. Verification Services

We may offer optional verification services for:

• STD Testing: Users may upload test documentation for review
• Identity Verification: Users may submit government-issued IDs or biometrics

We do not guarantee the authenticity or accuracy of any verification badge. Verified statuses are for informational and community trust purposes only.

10. Background Reports Disclaimer and Limitations

Our reports rely on third-party and user-submitted data. We do not guarantee their accuracy, completeness, or usefulness. Reports are for personal awareness only. You acknowledge that:

• Reports may contain outdated, incomplete, or inaccurate information
• We do not independently verify all data
• You use such reports at your own risk

Do not use reports for:

• Screening tenants, employees, or candidates
• Determining creditworthiness or insurability
• Any unlawful or discriminatory purpose

11. Dating Platform Features, Disclaimer, and Limitations

Body Proof enables users to engage with others through a dating platform that includes:

• Profile creation
• Search and matching tools
• Optional verification badges

We do not:

• Verify user intentions
• Guarantee relationship outcomes
• Perform comprehensive background checks

We do not vet every profile or guarantee outcomes. Use caution when interacting with others online or offline. You are solely responsible for your actions.

12. Beta Features and Product Changes

We may offer features marked as "beta," "experimental," or "early access." These features:

• Are provided "as-is" with no warranty
• May contain bugs or limited functionality
• Can be modified, suspended, or removed at any time

13. Subscriptions & Payments

Some features may require one-time payments or subscriptions. By purchasing:

• You agree to the pricing and billing frequency
• Payments are non-refundable unless required by law or stated otherwise
• You authorize us or our third-party provider to charge your payment method

It is your responsibility to cancel any recurring charges before the billing date.

14. Privacy Policy

All use of our services is also governed by our Privacy Policy, which explains how we collect, use, and disclose your personal information.

15. Intellectual Property

All Platform content, trademarks, and intellectual property belong to Body Proof or its licensors. You may not reproduce, distribute, or modify any content without written permission.

You may not:

• Reverse-engineer the Platform
• Use scraping tools or automated bots
• Frame or mirror any part of the Platform

16. Termination

We reserve the right to suspend or terminate your account at any time if you:

• Violate these Terms
• Engage in behavior that endangers others or the Platform
• Use the Platform in a fraudulent, abusive, or illegal manner

Termination may result in loss of data or access to services. You may close your account at any time through your settings.

17. Disclaimers

The Platform is provided "as-is" and "as available" without warranties of any kind. We do not guarantee:

• Availability of services
• Accuracy of information or reports
• That the Platform will be error-free or secure

You use the Platform at your own risk.

18. Limitation of Liability

To the maximum extent permitted by law, Body Proof and its affiliates are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Harm arising from user content or third-party conduct

In any case, our total liability will not exceed the greater of $100 or the amount you paid in the last 12 months. You use our services at your own risk.

19. Indemnification

You agree to indemnify and hold harmless Body Proof LLC, its officers, directors, employees, and affiliates from any claims, losses, damages, or legal fees arising from:

• Content you provide
• Your use of the Platform
• Your violation of these Terms or applicable law

20. Dispute Resolution & Arbitration

If a dispute arises, contact us first to try resolving it informally. If unresolved, you agree to:

• Waive any right to a jury trial or class action
• Conduct arbitration in the state of Missouri
• Binding arbitration under the rules of the American Arbitration Association (AAA)

Some claims may qualify for small claims court.

21. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law provisions.

22. Changes to Terms

We may modify these Terms at any time. Changes will be posted to the Platform with a revised effective date. Continued use of the Platform constitutes acceptance.
